Terms and Conditions
These Terms and Conditions (“Terms”) govern access to and use of the EasyJobs websites, job pages, feeds, dashboards, and related services (the “Service”). The Service is operated by EasyJobs Australia (“we”, “us”, “our”), the Australian registered business name for this platform. By creating an account, posting a job, applying for a role, or otherwise using the Service, you agree to these Terms.
EasyJobs Australia operates EasyJobs primarily for use in Australia. These Terms are governed by the laws of Australia, and where a state or territory must be nominated, the laws of Victoria, Australia. These Terms are not legal advice.
1. Who may use EasyJobs
- You must be able to form a binding contract under Australian law.
- Employer accounts are for genuine businesses or organisations recruiting for real roles.
- Candidates must provide accurate information when applying for jobs.
- You must not use the Service if doing so would breach applicable law or a sanction/restriction that applies to you.
2. Accounts and security
- You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
- Provide accurate registration details and keep them reasonably up to date.
- Notify us promptly if you suspect unauthorised access to your account.
- We may suspend or restrict access where we reasonably believe there is a security risk, misuse, or breach of these Terms.
3. Employer responsibilities
If you use EasyJobs as an employer, you agree that:
- Job ads must be for genuine, currently available paid employment or engagement opportunities (not schemes whose main purpose is lead generation, franchise sales, or collecting candidate data for unrelated use).
- Job content must be accurate, not misleading, and compliant with Australian consumer and advertising laws.
- You must not publish discriminatory job requirements prohibited by Australian anti-discrimination laws (including requirements based on protected attributes unless a lawful exception applies).
- You are responsible for your recruitment decisions and for how you use candidate information once you receive it.
- You must handle candidate personal information in accordance with the Privacy Act 1988 (Cth) and your own privacy obligations.
- Business details you submit (including ABN and legal name) must be true and used for legitimate verification and trust purposes.
- You must not misuse applicant data, including selling applicant lists or contacting applicants for unrelated marketing without a lawful basis and consent where required.
4. Candidate responsibilities
If you apply for roles through EasyJobs, you agree that:
- Information and documents you submit are true, accurate, and not misleading.
- You have the right to provide any resume or materials you upload.
- Submitting an application does not guarantee an interview, offer, or employment.
- The employer (not EasyJobs) decides recruitment outcomes for each role.
5. Job content, feeds, and distribution
Employers authorise EasyJobs to host and display their job ads on public pages and, where enabled, to distribute job data via feeds or integrations with third-party job sites and search services. EasyJobs does not guarantee placement, ranking, traffic, or applications from any channel.
We may refuse, edit, unpublish, or remove job content that we reasonably consider unlawful, misleading, discriminatory, spammy, unsafe, or otherwise inconsistent with these Terms or platform quality standards.
6. Applications and communications
- Applications submitted for a job are made available to the employer associated with that job.
- Employers may contact applicants using details provided in the application for recruitment purposes.
- EasyJobs may send transactional notices (for example application received or employer notifications). Marketing emails are sent only in accordance with your preferences and applicable law.
7. Acceptable use
You must not:
- Use the Service for unlawful, fraudulent, or harmful purposes
- Scrape, harvest, or bulk-export candidate or employer data without permission
- Interfere with platform security, access controls, or integrity
- Upload malware, or attempt to reverse engineer non-public parts of the Service
- Impersonate any person or misrepresent your affiliation
- Post content that is defamatory, obscene, hateful, or infringes others’ rights
- Use bots or automation in a way that degrades or abuses the Service
8. Intellectual property
EasyJobs Australia and its licensors own the Service, branding, software, and platform content (excluding your job ads, business materials, and candidate application materials). You retain ownership of content you submit, and you grant EasyJobs Australia a non-exclusive licence to host, store, reproduce, and display that content as needed to operate and distribute the Service.
9. Privacy
Our collection and handling of personal information is described in our Privacy Policy. By using the Service, you acknowledge that policy. Employers must also meet their own privacy obligations when handling candidate information.
10. Third-party services
The Service may link to or integrate with third-party sites and tools (for example email providers, hosting, ABN registers, or job aggregators). We are not responsible for third-party terms, content, or availability. Your use of third-party services is at your own risk and may be subject to separate terms.
11. Availability and changes to the Service
We aim to keep EasyJobs available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change as we improve the product. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.
12. Fees
Some EasyJobs features may be offered free of charge. If paid plans or promotion products are introduced, pricing and billing terms will be shown before purchase and form part of these Terms for that purchase.
13. Disclaimer
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. EasyJobs Australia does not warrant that using the platform will result in hires, applications, or any particular business outcome. We do not employ candidates on behalf of employers and are not a party to any employment contract between employers and candidates.
14. Australian Consumer Law
If you acquire services as a consumer under the Australian Consumer Law, you may have guarantees that cannot be excluded. Nothing in these Terms excludes, restricts, or modifies those non-excludable rights. Where our liability can be limited in relation to goods or services that are not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited (at our option) to resupplying the services or paying the cost of resupply.
15. Limitation of liability
To the maximum extent permitted by law, EasyJobs Australia is not liable for indirect, incidental, special, consequential, or loss of profit, data, goodwill, or business opportunity arising from your use of the Service. Our aggregate liability for all claims relating to the Service is limited to the fees you paid us for the Service in the 12 months before the claim (or AUD $100 if no fees were paid), except where liability cannot be limited under applicable law.
16. Indemnity
You agree to indemnify EasyJobs Australia against reasonably foreseeable losses, claims, and expenses arising from your unlawful use of the Service, your job content, your misuse of candidate data, or your breach of these Terms, except to the extent caused by our negligence or wrongful act.
17. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create legal or security risk, or misuse the platform. Provisions that by nature should survive (including intellectual property, liability, and indemnity) continue after termination.
18. Changes to these Terms
We may update these Terms from time to time by posting a revised version on this page. Continued use of the Service after the effective date constitutes acceptance of the updated Terms, except where applicable law requires a different process.
19. General
- If any part of these Terms is unenforceable, the remainder still applies.
- Our failure to enforce a provision is not a waiver of our rights.
- These Terms are the entire agreement between you and EasyJobs Australia about the Service, unless a separate written agreement says otherwise.
